Elite Lawn & Landscape, LLC – Limited Warranty

Effective Date

This Limited Warranty becomes effective on the date Elite Lawn & Landscape, LLC (“Elite”) generates the invoice for services rendered (the “Completion Date”).

Warranty Periods

• Paver Driveways, Walkways, and Patios: 12 months from Completion Date
• Retaining Walls: 12 months from Completion Date
• Irrigation Systems: 45 days from Completion Date
• Plants (Trees, Shrubs, and Other Live Plant Material): up to 7 days from Completion Date

Scope of Limited Warranty

This warranty applies only to:

• Paver driveways, walkways, and patios
• Retaining walls
• Irrigation systems
• Plant material (as noted above)

Elite is not a manufacturer of materials and does not provide warranties on products or materials themselves. Any material warranties are solely those provided by the manufacturer.

Covered Workmanship

• Pavers: Free from defects in workmanship and installation, including shifting or settling due to improper base preparation or compaction.
• Retaining Walls: Free from defects in workmanship and installation, including shifting or settling due to improper base preparation or compaction.
• Irrigation Systems: Free from defects in workmanship and installation.
• Plants: Free from defects related to installation and initial viability for up to 7 days, provided proper watering and care instructions are followed.

Owner Responsibilities

• Provide written notice to Elite of any claimed defect within the applicable Warranty Period.
• Allow Elite reasonable access to the property during normal business hours (Monday–Friday, 8:00 AM–5:00 PM ET) for inspection and, if necessary, repair.

Failure to provide timely notice or access may void warranty coverage.

Elite’s Warranty Obligations

Upon receiving written notice during the Warranty Period, Elite may inspect, investigate, and/or test the claimed defect. If deemed a covered defect, Elite will, at its sole discretion, repair or replace the defective workmanship or installation. Repairs or replacements will be completed within a reasonable time, not to exceed 30 days, subject to delays beyond Elite’s control.

Exclusive Remedy

The Owner agrees that repair or replacement of defective workmanship or installation—at Elite’s option—is the sole and exclusive remedy under this Limited Warranty.

Disclaimer of Other Warranties

This Limited Warranty replaces and excludes all other warranties, whether express or implied, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, suitability, or quality. This warranty is non-transferable and applies only to the original Owner.

Limitation of Liability

Elite shall not be liable for:

• Loss of profits
• Loss of use
• Indirect, special, incidental, punitive, or consequential damages

Warranty Exclusions

This Limited Warranty does not cover:

• Damage from misuse, neglect, improper maintenance, negligence, or abuse
• Damage caused by third parties or events beyond Elite’s control, including storms, floods, fire, hail, lightning, wind, falling trees/objects, vehicles, insects/animals, earth movement, or changes in groundwater levels
• Failure by the Owner to act promptly to minimize damage
• Issues discovered or reported after the Warranty Period
• Normal settling/movement of retaining walls resulting in gaps < 1.5 inches
• Paver driveways subjected to vehicles > 4,500 lbs or non-road-rated tires (e.g., mud-terrain)
• Any corrective action by Elite does not extend the Warranty Period
